1. COMPANY IDENTIFICATION AND TRADEMARK STATEMENT
 
This document constitutes the Terms and Conditions agreement that governs the legal relationship between APU SAS, a commercial entity legally incorporated in Colombia, and users who access or conduct transactions through this website. Under the brand name APU Coffee, identified by the slogan “Supreme Fragrance of the Mountain”, our organization represents a legacy spanning three generations of the Llanos family in the department of Huila.
 
Founded in 2012 by Catalina Castillo y Miguel Llanos, APU SAS guarantees an artisanal production process with strict quality standards, social and environmental responsibility, and traceability from the El Carmelo Ranch (Teruel, Huila), located at 1,700 meters above sea level.
 
For the purposes of quality control and technical processes, the company has the Delfín Llanos Thresher and Roaster, a technical facility responsible for ensuring the quality of the grain prior to distribution. The official contact channels and administrative offices are listed below:

2. ACCEPTANCE OF TERMS AND GOVERNING LAW
 
Accessing, browsing, and using this website implies the express and unconditional acceptance of these Terms and Conditions, which are governed by the Law 1480 of 2011 (Consumer Protection Statute) and other related provisions of Colombian commercial law.
 
The user acknowledges that any electronic transaction constitutes a distance selling contract. If the user does not agree with the provisions contained herein, they should refrain from using the site. The validity period is specifically indicated. Right of Withdrawal pursuant to Article 47 of Law 1480 of 2011, subject to the nature of perishable products (coffee) and the applicable legal exceptions.
 
3. PRODUCT CATALOG AND COMMERCIAL POLICY
 
The products offered are specialty coffees from Huila. Prices are listed below. Colombian Pesos (COP) and include statutory taxes (VAT) where applicable under the prevailing tax regime.
 
Availability and Special Editions
  • Gesha 10th Anniversary Kit: This limited edition (Natural, Honey, and Washed processes) is subject to limited stock. It can be purchased in-store or through this digital channel, depending on availability.
  • Accessories and Souvenirs: The exclusive items attributed to Juliana Higuita belong to the partner brand. @accessorydual. APU SAS acts as a commercialization platform, respecting said third party's intellectual property rights.
APU SAS reserves the right to modify prices without prior notice, while always guaranteeing that the price published at the time of actual order confirmation is honored.
 
4. PURCHASE PROCESS AND DATA PROTECTION (HABEAS DATA)
 
The purchase process requires selecting specifications (grind and weight), using the shopping cart, and validating the checkout. In compliance with the Law 1581 of 2012, APU SAS informs that the personal data collected during the transaction will be processed under strict security and confidentiality policies for the purposes of order processing, logistics, and customer service. By providing their information, the user grants express authorization for such processing.
 
Transactions are executed via payment gateways that comply with industry data security protocols, ensuring the integrity of the financial process.
 
5. LOGISTICS, COVERAGE, AND EXPORTS
APU SAS manages shipments under a premise of “from Finca El Carmelo to the world”, under the following conditions:
  • National Coverage: We operate with robust logistics serving Neiva, Teruel, Medellín, and Cartagena, with the capacity to deliver throughout Colombia.
  • International Coverage: We declare our operational capacity for the export of specialty coffee to United States, Europe and other international markets, subject to the regulations of the National Federation of Coffee Growers of Colombia.
Delivery times are estimates subject to the handling of third-party logistics providers and do not constitute an obligation to achieve an exact result in terms of hours.
 
6. INTELLECTUAL AND INDUSTRIAL PROPERTY
 
The brand APU Coffee (a term derived from the concept of “leader” or “chieftain”), as well as the seal Huila Origin Brand, logos, audiovisual material of the El Carmelo Farm and the website design are the exclusive property of APU SAS.
Our visual identity has the institutional recognition of Second Place for Best Image obtained in the “Placita de Café” competition, awarded by the Government of Huila and the Chamber of Commerce (CC San Pedro Plaza).
 
Any reproduction, use, or transformation of these assets without prior written authorization is prohibited, subject to the legal actions provided for in Andean Community Decision 486.
 
7. LIMITATION OF LIABILITY
 
APU SAS Liability is excluded in the following instances:
  1. Technical interruptions to the web portal beyond the company's control.
  2. Misuse or improper storage of the product after delivery to the consumer.
  3. Inability to deliver or delays resulting from incorrect, incomplete, or inaccurate shipping information provided by the customer.
8. APPLICABLE LAW AND JURISDICTION
 
These terms are governed exclusively by the laws of the Republic of Colombia. In case of disputes, the parties will exhaust a direct settlement stage. Should the conflict persist, the users and APU SAS They waive any other jurisdiction and irrevocably submit to the jurisdiction of the judges of the Republic of Colombia, specifically to the jurisdiction of the Neiva Judicial Circuit, Huila.
